Such settlements make no economic sense except as a form of unlawful payment not to compete. Since the U.S. Supreme Court’s ruling in FTC v. Actavis in 2013, such settlements can violate the antitrust laws, and injured purchasers can now recover the ill-gotten gains of such conduct.
